Terms of service
GENERAL
The client is only purchasing digital files. It will be delivered through email.
> The client holds responsibility to save the files of any finished commission within one week after the delivery. I might periodically clean my laptop so I might not be able to retrieve it for you.I reserve the rights to decline and / or cancel the commission if the request makes me uncomfortable or I'm unable to work on it anymore. *Please refer to the payments & refunds section.The client will hold and maintain all confidential information, such as commission price agreement and personal information (names, etc.), private.By submitting your request, you agree to the following Terms of Service. I do not take any responsibility if client fails to read the T.O.S.PAYMENTS
Prices are in USD currency.Payment must be upfront through VGen services, Ko-Fi, or PayPal invoice.
> Once an invoice has been sent, the payment must be submitted within 5 days. The commission request will be cancelled should the payment not be made by the specified date.
> Payment split by milestones is only available for commissions above 100 USD.Extra fees:
> I will inform you of any extra fee. You may switch out the character or alter your order if you do not want to be charged extra. Extra fees are for complicated or detailed designs, and any additional items.REVISIONS
A maximum of 5 revisions for each stage (sketch idea, color test, finished).
> Free 3 minor changes (finished stage).
> Major changes will not be accepted past the color test stage. It will be charged as a new art commission.I will gladly correct any mistakes on my behalf, free of charge.DEADLINES AND DELIVERY
The estimated delivery time of the final product is two months. Any request for a specific date will have an extra cost.
> I will send watermarked updates. Expect updates between Friday and Sunday. Client may ask for WIPs anytime.
> Turnaround time can vary depending on my schedule and how busy I am.Commissions are not "First Come First Served". I generally follow the order of my Carrd / Toyhouse queue, but I might break the order or take a break from the commission and work on another project to avoid losing motivation or inspiration.COMMUNICATION
All messages not related to the commission will be ignored. Please keep the conversation strictly business.
The best way to contact me is through instagram, discord (twomate) or email ([email protected])Client must remain communicative to ensure that progress can be continuously made till the deliverable date. Should the client maintain a non-communicative stand for more than 3 days, I have the right to proceed without the client's input, and may finish the commission should there continue to be no response for 7 days.
USE
The commissions can be used for personal and streaming purposes. Commercial commissions must be discussed first.I own the intellectual property of my artwork and must be given credit on all social media platforms.Client is permitted to repost it but must always give me credit redirecting to my social media profile (splepytwo).The signature cannot be deleted.Client is not permitted, under any circumstances, to:
> Use any part of the commission for AI training / generation, non-fungible tokens (NFT), cryptocurrency, NSFW content creation, hate or discrimination.
> Resell or use the commission for commercial purposes without given permission.
> Use the discarded sketch ideas unless the client buy them.
> Edit or reproduce the commission unless I provide written permission.REFUNDS
Refunds are only accepted if I haven't started the sketch yet.Exceptions:
> If I'm unable to make the due date I will contact you to arrange a new completion date. If the new date does not meet the client's needs, they will receive a full refund.
> Clients have full rights to refunds if I miss the set date.
> If I'm unable finish the commission, the customer gets a full refund.Refunds do not include the digital files of the commission. The client is prohibited to use any part of the commissioned art if the commission is fully refunded.PROCEDURE
